Purchasing a vehicle is a substantial investment, and we always expect our vehicles to be of merchantable quality and meet specific quality standards.

Once in a while, the vehicles’ condition may not meet the expectations due to defects, misrepresentations, or poor services from the dealer/ vendor. Thus, you may wish to claim your losses against the dealer/ vendor by filing claim at Tribunal for Consumer Claims Malaysia (TCCM).

Common Grounds for Filing to Tribunal Court

  • Defect that was not disclosed to consumer during the purchase (e.g. faulty engine, defective parts, workmanship)
  • Misrepresentation of the vehicle’s condition (e.g. tampered odometer, false information)
  • Failure to provide after sales service agreed upon (e.g. warranty or after-sale service not honored)
How to request a Consent Letter for Tribunal Claims on Defective Motor Vehicle from the Bank

After filing of Claim of Statement Form (Form 1) at Tribunal for Consumer Claims Malaysia office or file online through e-Tribunal System.

Step 1

Visit the nearest Credit Administration Centre (CAC) / Hire Purchase Centre (HPC) / Hire Purchase Hub (Hub)/ Branch to submit the request for Consent Letter with following required documents:

  • Formal Written Request addressing to the Bank describing the defect(s) in detail; and
  • Form 1 (Statement of Claim) or Form 4 (Notice of Hearing) issued by Tribunal; and
  • Supporting Documents submitted to Tribunal for Consumer Claims Malaysia / e-Tribunal system.

Requirement prior to Request of Consent Letter
1. No overdue instalments of the said HP/ AITAB HP-i facility;
2. No ongoing complaint / legal action taken against the Bank.


Note:

Request for Consent Letter with incomplete documentation or does not meet the above requirements will not be processed.
Step 2

The Bank will process your application and revert with Bank’s Consent Letter within 14 calendar days.
